Motorcycle Track Activity Waiver & Participation Agreement
IMPORTANT – READ CAREFULLY BEFORE SIGNING
This is a legal document that affects your rights.
1. Agreement to Participate
In consideration of being allowed to participate in motorcycle riding activities at Murray Valley Training Centre (MVTC), I agree to the terms set out in this document.
2. Acknowledgement of Risk
I understand that motorcycle riding is a dangerous recreational activity and involves significant risks, including:
- Serious injury or death
- Falls or loss of control of a motorcycle
- Collision with other riders, vehicles, or objects
- Track surface hazards and changing conditions
- Mechanical failure
- Weather conditions (heat, cold, rain, etc.)
- Actions or negligence of other participants
I acknowledge that these risks cannot be completely eliminated.
3. Voluntary Participation
I confirm that:
- I am participating voluntarily
- I am physically and mentally fit to participate
- I have had the opportunity to read and understand this agreement
- I accept that I can choose not to participate
4. Release and Waiver of Liability
To the fullest extent permitted by law, I:
- Release and discharge Murray Valley Training Centre, its owners, operators, staff, contractors and agents (“MVTC”) from all liability for any injury, loss or damage arising from my participation
- Agree that MVTC is not responsible for any personal injury, death, or property damage I may suffer
This includes liability arising from negligence, except where the law does not allow exclusion.
5. Medical & Safety
I agree that:
- I am responsible for my own medical and ambulance costs
- MVTC may arrange medical treatment for me if necessary
- I will follow all safety directions, rules, and instructions
6. Personal Responsibility
I acknowledge that:
- I am responsible for my riding behaviour and decisions
- I will ride within my skill level
- I will not participate under the influence of drugs or alcohol
7. Photography & Media
I consent to MVTC using photos or videos of me for promotional purposes without compensation.
8. Privacy
I consent to MVTC collecting and using my personal information for event administration and safety purposes.
9. WARNING (Victoria Law Requirement)
Under the Australian Consumer Law and Fair Trading Act 2012, several guarantees normally apply to recreational services.
By signing this agreement, you acknowledge that:
- Your rights to sue MVTC for injury or death caused by a failure to use due care and skill are excluded, restricted or modified
- This exclusion does not apply to gross negligence
Gross negligence means acting with reckless disregard for the consequences.
10. Parent/Guardian Consent (if under 18)
I, as parent or guardian, consent to the participant taking part in the activity and agree to this waiver on their behalf.
11. Definitions
Participant – the person signing this agreement
MVTC – Murray Valley Training Centre and all associated staff, contractors and representatives
Activity – motorcycle riding or related track activities conducted by MVTC
12. Declaration
I have read, understood, and agree to be bound by this waiver.
